LEGAL • BINDING UPON PURCHASE
Export & International Sales Policy
DOCUMENT XP-1.0 • EFFECTIVE OCTOBER 20, 2026 • APPLIES TO ALL ORDERS SHIPPED OUTSIDE THE 50 U.S. STATES
Document XP-1.0 • also in the Forms & Documents Library
§1 — SCOPE
This policy governs all sales by American Mortuary Coolers, American Mortuary Equipment, U.S. Pathology Equipment and Funeral Source One Supply Company, Inc. shipped to, or intended for use in, any destination outside the 50 United States, including U.S. territories in the Caribbean and Pacific. It supplements the Terms of Purchase, Return & Chargeback Policy (TC-1.7). If they conflict, the written quote controls, then this policy, then TC-1.7.
§2 — INCOTERMS AND FREIGHT
Unless the written quote states otherwise, international orders are sold EXW (Ex Works) Johnson City, Tennessee, or FOB a named U.S. port, under Incoterms 2020. Risk of loss passes to the buyer at that point. The buyer pays international freight, marine or cargo insurance, export packing beyond standard crating, and all destination charges.
§3 — DUTIES, TAXES AND IMPORT COMPLIANCE
The buyer is the importer of record and is solely responsible for import duties, VAT/GST, brokerage fees, port charges, permits, and compliance with the electrical, refrigerant and import rules of the destination country. Equipment built for the U.S. market is not represented to meet any other country’s requirements unless the written quote says so.
§4 — EXPORT CONTROL
All exports comply with U.S. law, including the Export Administration Regulations (EAR) and U.S. sanctions programs. Goods may not be sold, diverted or re-exported to embargoed or sanctioned countries or to restricted parties. By ordering, the buyer certifies it is not a restricted party and will not divert the goods contrary to U.S. law. We may cancel any order that would violate these rules.
§5 — VOLTAGE AND CONFIGURATION
Units requiring 50 Hz power, non-U.S. plugs, or destination-specific refrigerants must be specified at the time of quoting. Changes after production starts may carry re-engineering charges and new lead times.
§6 — PAYMENT AND CANCELLATION
International orders require payment in full in U.S. dollars by wire transfer before production or release, unless net terms are approved in writing under our Net Terms program. Bank and wire fees are paid by the buyer. Built-to-order export equipment is non-cancellable once production begins under the Custom & Built-to-Order Equipment Policy (CO-1.0).
§7 — WARRANTY OUTSIDE THE U.S.
Warranty coverage is limited to the terms of the Warranty Policy (WR-1.0) and, for self-contained uprights, roll-ins and vaults, the Upright Refrigeration Warranty Claim Procedure (RW-1.0). Reimbursement is paid in U.S. dollars at wholesale part cost. International freight, duties and local labor for warranty parts are the buyer’s responsibility.
§8 — DISPUTES AND GOVERNING LAW
Payment disputes and chargebacks are handled under the Terms of Purchase, Return & Chargeback Policy (TC-1.7) and the Dispute Resolution & Formal Review Policy (RR-1.0). A written formal review request to resolutions@mymortuarycooler.com is required before any chargeback, claim or legal action. This policy is governed by Tennessee law, with exclusive venue in the state courts of Washington County, Tennessee. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. The prevailing party recovers reasonable attorney fees and costs.
